Community Punishment for Illegal Waste Deposit

A Dipton man was in court today (Friday) after using illegal waste as hard
core on his land at New Kyo, Co
Durham.
Ian Chester
admitted one charge of permitting the deposit of controlled waste, namely
household waste, and one charge of permitting the disposal of waste by
burning on land where no waste management licence was in force between
January 1, and
June 25, 2002.
The deposit
offence was contrary to Sections 33(1)(a) of the Environmental Protection
Act 1990 and the disposal by burning contrary to Section 33(1)(b) of the
same act.
Chester, 23, of Bradley Terrace, Dipton,
Co
Durham, was given 100 hours community punishment
by Durham Crown Court and ordered to pay £1500 towards costs.
Environment
Agency officers spotted the illegal activity on a field behind Unity
Terrace, New Kyo, Co
Durham
on June 25, 2002. The field was almost entirely covered in waste
material such as bricks, rubble, wood, paper, glass and plastics.
A fire was
burning in the middle of the site and the officers saw two men loading
more waste into the front bucket of a caterpillar-type vehicle.
The officers
took photographs and handed one of the men a notice instructing them to
stop what they were doing immediately until there was further contact from
the Agency. Witnesses tracked down from evidence at the site all
identified the same skip hire firm.
In an
interview with Agency officers,
Chester
claimed he had bought the field with the intention of setting up a horse
arena and stables. He had asked for waste to flatten the area, but refused
to say who actually deposited the waste on the land.
The court was
told today that
Chester
felt he had been duped by other people into committing the offences.
After the
case Special Enforcement Officer Roy Howitt said: "There are exemptions
for certain types of waste to be used for levelling or maintaining
agricultural land and Agency officers are more than happy to advise people
who wish to do this.
"We expect
people to dispose of their waste in a responsible manner at appropriate
civic amenity sites. We will always prosecute those who don’t dispose of
their waste responsibly."
